RBI PRIVACY NOTICE

This Privacy Notice describes how Ridder/Braden, Inc., and RBI Strategies and Research, 1888 N Sherman St. Suite 420, Denver, CO 80203, 303.832.2444, (“RBI Strategies and Research”, “RBI” or we, us or ours) collects, uses, shares and protects personal information we collect from clients, participants, and visitors of this website, as well as the choices each has with respect to their personal information.

1.   THE SOURCES OF PERSONAL INFORMATION WE COLLECT

We collect personal information from the following sources:

1.1.   Clients – individuals who register, on their own behalf or on behalf of an entity, to use RBI’s Services;

1.2.   Participants – individuals who provide their information to RBI or a Client of RBI when they sign a petition, join a membership organization, subscribe to marketing material, participate in surveys, or attend other functions; and

1.3.   Website Visitors – individuals who visit RBI’s website and opt to provide contact information including an email address to receive communications from RBI.

2.   THE TYPES OF PERSONAL INFORMATION WE COLLECT

2.1.   Clients – RBI collects personal information about Clients, including name, business name, email address, physical address, phone number, website domain, and any other personal information that the Client provides us so that we are able to perform RBI Services.

2.2.   Participants – RBI collects personal information about Participants who voluntarily choose to participate in events or surveys, or to subscribe to marketing materials, including name, email address, physical address, and phone number.

2.3.   Website Visitors –RBI automatically collects information about Website Visitors while they are viewing our website, including web server logs, internet protocol (IP) addresses, browser type, or other information is collected as part of aggregated data.

3.   HOW WE USE/PROCESS PERSONAL INFORMATION

RBI uses/processes personal information where:

3.1.   We have your explicit consent to do so;

3.2.   It is necessary for RBI to provide Services to a Client, which is the data controller, pursuant to a  performance of a contract, including to bill and collect payment for, our Services;

3.3.  We need to respond to any request from you for our support, or contact you about changes to our Services or website;

3.4.   Where we need to comply with a legal obligation;

3.5.   With your consent to provide you with marketing emails, advertising campaigns, or newsletters;

3.6.   Where it is necessary for the legitimate interests (or those of a third party) providing that our legitimate interest is not overridden by your interests or rights which require protection of your data. These legitimate interests include:

  • ensuring the effective administration and management of the Employment Organization and your employment or engagement;
  • ensuring our assets are sufficiently protected and kept confidential;
  • taking legal or other professional advice, including in relation to legal disputes in relation to you or others; and
  • facilitating business continuity.

At any time, you have the right to withdraw or decline consent. Also, you have the right to object where we rely on our legitimate interests to process your personal information.

For individuals in the EEA, RBI’s legal basis for processing personal information will depend on the personal information collected and the specific context in which we collect it.

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose, and we do not make any decisions about anyone using automated means. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

4.   HOW WE SHARE PERSONAL INFORMATION

RBI shares personal information it collects about you in the following ways:

4.1.   Third Party Providers and Processors – RBI may share your information with third party providers and processors that provide Services on our behalf. These companies may assist with marketing support, content creation, content delivery, event management, or event logistics. Third party providers may only process personal information pursuant to RBI’s instructions, and in compliance with the Privacy Policy and other applicable regulations.

4.2.   Advertising – Based on the cookies and other tracking devices, we may work with advertising companies to display ads that may be of interest to you.

4.3.   Business Transactions – To provide information to a third party in the event of any disposition of all or any portion of our business (e.g., reorganization, sale, assignment, bankruptcy).

4.4.   Aggregated or De-identified Data – We may disclose or use aggregated or de-identified information with third party providers for research purposes relating to our Services.

4.5.   As Required by Law or Similar Investigations – To comply with legal obligations (e.g., subpoena) or investigate potential legal violations.

4.6.   Safety – We may disclose your information to protect and defend the safety of RBI in connection with investigating and preventing fraud or security issues.

With respect to your account information, you may update, correct or delete information that you provided to us by contacting us at michael@rbistrategies.com.

6.   DATA RETENTION AND SECURITY

When RBI (and third party processor) no longer has a legitimate business need to process your personal information, or no longer has a need to keep your personal information for any legal, tax, or regulatory reason, we will delete it.

RBI takes all reasonable steps to protect information received from you from loss, misuse or unauthorized access, disclosure, alteration, and/or destruction. We maintain technical, physical, and administrative safeguards to secure your information. Despite the use of encryption, RBI cannot guarantee any method of transmission of information over the internet is 100% secure. 7.   INTERNATIONAL TRANSFERS

RBI is a US company and stores your information (or directly with a third-party processor) in the U.S. RBI may receive a transfer of your personal information from Client, to perform Services pursuant to an agreement with Client, where Client has received your consent in your interest or it is in Client’s legitimate interests. Once the Service is completed, RBI (or third-party processor) deletes the personal information.

8.   DURATION OF USE/PROCESSING

We will only retain personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

9.   DATA SUBJECT RIGHTS

Individuals located in the EEA may have additional statutory rights available to them with respect to their personal information, including the right to access your personal information, have it erased, have it corrected, or object to or restrict processing. If you would like to make such a request, please email info@rbistrategies.com and we will respond within thirty (30) days. RBI will need to verify that the individual is inquiring about his/her own information before we can assist with the request.

We will comply with such requests to the extent legally required by applicable law. For EU individuals, you also have the right to lodge a complaint with the supervisory authority.

Subject to certain exemptions, you have certain rights over your personal information. The following table explains your rights and how to use them.

  • your rights to correct or object to our processing of your information,  to have your information erased or the processing restricted;
  • your right to lodge a complaint with a supervisory authority (such as the Information Commissioner in the UK);
  • the source of your information where it has not been provided by you;
  • the existence of certain automated decision making processes using your data;
  • the transfer of your information to countries outside of the EU and the safeguards in place; and
  • your right to a copy of the information about you which is being processed by us.

We will provide a copy of the personal data without charge. For any further copies requested, we may charge a reasonable fee based on administrative costs.

 

3 You can ask to correct your information if it is wrong. You can email your request to: michael@rbistrategies.com.
4 You can ask us to delete certain of your information in certain circumstances, including the following (this is not an exhaustive list):

  • The personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • To the extent that we rely on consent, you have withdrawn consent and there is no other legal basis for processing;
  • You have exercised your right to object to the processing and there are no overriding legitimate grounds for the processing to continue.

There are also certain exceptions where we may refuse a request for erasure, for example, where the personal data is required for compliance with law or in connection with claims.

5 You have the right to request that we suspend the use/processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.  
6 You can ask us to help you move certain of your personal information to other companies.

Where we are relying upon the legal basis either of consent or that the use/processing is necessary for the performance of a contract to which you are a party and that personal data is processed by automatic means (e.g., electronically), you have the right to receive all the personal information you have provided in a structured, commonly used and machine-readable format and to transmit this to another controller directly, where this is technically feasible.

7 You can ask us to stop using/processing your personal information, but only in certain cases.

This applies where we are using/processing your personal information based on a legitimate interest (or those of a third party) and you may object to use/processing on this ground.  However, we may be entitled to continue using/processing your information based on the our legitimate interests.  You also have the right to object where we are using/processing your personal information for direct marketing purposes.

8 You also have a right to lodge a complaint with a supervisory authority, in particular in the Member State in the European Union  where you are habitually resident, where you work or where an alleged infringement of Data Protection law has taken place.

 

For persons in the European Economic Area, legal remedies in connection with the use/processing of personal data may be sought before the authority responsible for the relevant jurisdiction.

 

 

Where we receive a request to exercise one of these rights, we will provide information about our response within one month of receiving the request. This may be extended by a further two months in certain circumstances, including, for example, where requests are complex or numerous.

We will provide requested information free of charge, except where requests are manifestly unfounded or excessive, in particular because of their repetitive character. In these circumstances, we may charge a reasonable fee or may refuse to act on the request. We will advise you of any fees prior to proceeding with a request. We may ask you to verify your identity before carrying out a request.

Where we do not carry out your request, we will inform you without delay and within one month of receipt of the request, together with our reasons for not taking the action requested. You have the right to raise a complaint with a supervisory authority or seek a remedy from a Court.

10. CHILDREN

Our Services are not directed at children, and We do not knowingly collect information from or about children under 13 years of age, and use of our services by children under 13 years of age is forbidden.

11. CHANGES TO PRIVACY NOTICE

RBI reserves the right to modify this Privacy Notice at any time, however, should we change the Privacy Notice in a material way, a notice will be posted on our website along with the updated Privacy Notice. If you disagree with the changes, you may terminate your Services.
